This is NOT about the proposed “Pandemic Treaty.”
This IS about the proposed amendments to the International Health Regulations and the method by which they are adopted.

Simply stated, 194 unelected, unaccountable and largely unknown delegates can easily change international law by achieving “consensus” in secret “informal” meetings and then simply remaining silent (tacit consent) while the document is being considered publicly.
The method (silence procedure) by which amendments to the International Health Regulations are adopted requires NEITHER a Presidential signature NOR the advice and consent of the Senate.
Amendments were adopted in this manner on May 27, 2022.
This can easily happen again in 2023 or 2024.
The “silence procedure” is a form of tacit consent or acceptance.
… a proposal with strong support is deemed to have been agreed unless any member raises an objection to it before a precise deadline: silence signifies assent – or, at least, acquiescence. This procedure relies on a member in a minority fearing that raising an objection will expose it to the charge of obstructiveness and, thereby, the perils of isolation.

Often the “silence procedure” is the last step in adopting or agreeing to specific text after the basic premises of the text have been agreed upon in previous negotiations.
Those who remain silent are taken to agree.
On May 27, 2022, at the 75th World Health Assembly, the 194 member nations adopted amendments to the International Health Regulations.
The ending was absolutely bizarre.

In my humble opinion, these amendments were illegitimately submitted on May 24, 2022, during the 75th World Health Assembly.

Article 55 of the International Health Regulations (ironically included within the document) clearly states that any proposed amendments must be submitted 4 months in advance of the World Health Assembly, even though these proposed amendments were submitted in the middle of the 75th Assembly.
Since the adoption of the amendments on May 27, 2022 (during the 75th World Health Assembly), no signatures by any Presidents or Prime Ministers have been obtained and no approval by the Senate, Congress or any Parliament has been obtained in order to “ratify” the amendments to the International Health Regulations.
Such approval is NOT needed.
Arguably, there are still several months left in the time period under which the 194 member nations may invoke their right to REJECT the amendments (under Article 61), but practically no one on earth seems to be aware of this situation.
On May 24, 2022, the World Health Assembly also adopted a funding document using the silence procedure (which will more than double the assessed funding of the WHO by member nations).

Anyone who is discussing the method by which the proposed “Pandemic Treaty” would be ratified is simply barking up the wrong tree. This is not about the “treaty.” This is about the amendments to the IHR.
The method by which proposed amendments are adopted by the World Health Assembly and would thus alter the legally-binding International Health Regulations would require NEITHER the signature of the President NOR the advice and consent of the Senate.
